Overview

For more than thirty years, Henry L. Saurborn, Jr. has represented domestic and international clients facing a wide variety of complex legal problems, both locally and across the United States.  After law school, Henry clerked for several years for a federal judge at both the trial and appellate levels, which has helped him assist his clients to successfully navigate their disputes through the federal and state trial and appellate courts and in arbitration.  Before co-founding KSM in 1997, Henry honed his skills at one of the leading international law firms and several smaller boutique firms.

Henry principally focuses his practice in representing individuals and small business owners in employment and business ownership matters and disputes.  He has extensive experience in representing his clients in matters involving unfair competition, restrictive covenants and trade secrets, and has helped his clients both successfully defend and prosecute claims in this area.

He also represents and counsels his clients with respect to their external business disputes, whether in court or arbitration, employment issues including wage and hour matters, business formation, equity restructuring and borrowing, succession planning and business acquisitions and sales.

Henry also regularly advises and represents physicians and other allied health professionals with respect to employment and business ownership issues as well as matters of professional conduct and discipline and medical practice organization and management.

Henry serves as a court-appointed neutral and mediator, including pro bono, for the Commercial Division of the New York Supreme Court and the U.S. District Court for the Eastern District of New York.

Experience

Henry’s recent client engagements include:

  • Successfully defended a court action seeking to enjoin a sales professional from continuing employment with a competing entity, and successfully prosecuted counterclaims for unpaid sales commissions, obtaining a verdict under the New York Labor Law for unpaid commissions, statutory liquidated damages and attorney’s fees.
  • Successfully resolved breach of contract and fiduciary duty claims brought against a former major accounting firm partner.
  • Successfully tried and obtained a verdict in favor of a medical professional who suffered whistleblower retaliation by hospital administrators because of complaints made while serving as a member of multiple medical care quality control review committees.
  • Successfully defeated a court action by a medical practice to enjoin a former physician from establishing and conducting an independent practice in a nearby geographic area.
  • Represented and advised medical and financial services industry executives and professionals in negotiating new employment and equity participation terms, including in the context of acquisitions of existing employers, and with respect to professional moves to other leading industry firms.
